Terms of Use

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.


The domain name www.pulimart.com, and its Website and Mobile Apps hereinafter may referred to as “Pulimart” or “Platform” or “Our” or “Platform portal” or “Site” or “Platform site” owned by Pulimart Stores Private Limited a company incorporated under the Companies Act, 2013 (18 of 2013), registered office at KP X1-41,Kayyamkode Road, Cheleri (P.O), Kannur, Kerala, India 670604.hereinafter may referred to as “company” ."You" or "Your" or "participant" means the ‘user’ of the Platform. Each of Platform and Participant is referred to as a "Party" and collectively as "Parties"


General Information


Accessing, browsing or otherwise using the Platform will be construed as Your unequivocal and irrevocable acceptance and acknowledgement to the terms and conditions contained under Terms of Use and binding policies hereof. By using the Platform to have carefully read, understood and agree to be bound by these Terms of Use. Pulimart may at its sole discretion allow or disallow access to Platform and reserves the right to change any of the terms and conditions contained herein at any point in time. It is Your responsibility to periodically review these Terms of Use any update and changes and Your continued use of the Platform will be considered as Your acceptance to such updates and changes.


 ELIGIBILITY


You should have completed 18 years of age and be competent to enter into a contract under Indian contract law. If You are under 18 years of age who is intending to avail the services of the Platform should do so through Your legal guardian in accordance with applicable law. 


If You are using the Platform on behalf of any corporation, company, institution, association or other entity, the person should be authorized by such corporation, company, institution, association or other entity to use and access the App.


Pulimart reserves the right to refuse access to use the services offered at the Platform to new users or to terminate access granted to existing users at any time without according any reasons for doing so.


 COMPLIANCE REQUIREMENTS


 Every User of the Platform shall comply with all the applicable laws, including but not limited to the Foreign Exchange Management Act, 1999, notifications issued there under the Exchange Control Manual issued by the Reserve Bank of India, Customs Act, 1962, Information Technology Act, 2000, Prevention of Money Laundering Act, 2002, Foreign Contribution Regulation Act, 1976, Income Tax Act, 1961, Export Import Policy of the Government of India and shall include any amendments, notifications and Rules thereof under the aforesaid enactments applicable for using the App or buying/ selling any product or service through the Platform.


 Account and Registration


It is the user's responsibility to keep the details of the account and password confidential and you agree to accept responsibility for all activities that occur under Your Account or Password. Pulimart shall not be liable to any person for any loss or damage which may arise as a result of any failure by the user to protect the account details or the password. In case of any suspected breach please contact us immediately. If Pulimart has reason to believe that there is likely to be a breach of security or misuse of the Pulimart Platform, we may require you to change your password or we may suspend your account without any liability to Pulimart. 
You also agree to:
1. Provide true, accurate, current and complete information about yourself as prompted by Platform during the registration process (such information being the "Registration Data". e.g. like email address or mobile number etc)
2. Maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, incomplete, or not current or if Pulimart has reasonable grounds to suspect that such information is untrue, inaccurate, not current or not in accordance with the User Agreement, Pulimart will have the right to indefinitely suspend or terminate your membership and refuse to provide you with access to the Site.


DELIVERY POLICY


 Shipping Address


 Your shipping address and pin code will be verified with the database of Pulimart before You proceed to pay for Your purchase. In the event Your order is not serviceable by our logistics service providers or the area is not covered, we will request You to provide us with an alternate shipping address. You can make purchases on the Platform from anywhere in the world but at the same time You must ensure the payment and shipping address is within India.


 


When You submit an alternative address for delivery, you are responsible for accepting and collecting the package from such alternative address. Confirmation from the logistics service provider of successful delivery to the alternative shipping address is deemed as acceptance of delivery by You and Pulimart will have no liability in this regard.


 Delivery by Pulimart or Seller


The delivery of the ordered products from the seller to You will be made by logistics service providers assigned by Pulimart or Sellers. However, large and bulky products such as televisions, refrigerators, air-conditioners, furniture etc. may be delivered to You directly by the seller. Deliveries cannot be rescheduled after the order has been placed.


The logistics service provider assigned by Pulimart will make a maximum of three [3] attempts to deliver Your order. In case You are not reachable, available or do not accept delivery of products in these attempts Pulimart reserves the right to cancel the order at its discretion. You may be informed of such cancellation by email or SMS at the email address or mobile number provided to Pulimart. The cancelled order is returned to seller. You agree not to hold Pulimart liable for any cancellation.


 If You wish to request the Platform to resend the product, you can do so by placing a new order for the product on the terms set out on the [‘product order page’] when You place the new order. Your order will be accepted subject to availability of the product.


 In case there is any dispute regarding the shipment of the product or serviceability for the area not covered by the logistics service providers, Pulimart will not be responsible for the non-delivery of the product.


Title and risk of loss for all products ordered by You shall pass on to You upon delivery of the products at the shipping address provided by You.


 Multiple Product Orders


 In case You order multiple products in one transaction, Pulimart would endeavour to ship all products together. However, this may not always be possible due to some product characteristics or logistics issues or the location of seller and You may receive the products separately and at different times. If You purchase multiple products in a single transaction, then all the products would be dispatched to a single shipping address given by You. If You wish to ship products to different addresses, then You should book the orders separately based on the shipping addresses.


 Missing Items


 In the event, the product package received by You is missing one or more products or accessories or does not include the freebie or the order is partly delivered, you should inform Pulimart through the Customer Care Team within 2 days of delivery date of the package. Missing products claims will not be accepted after 2 days from delivery date.


When a package delivered is missing one or more products or accessories, you are requested to return the original package delivered to the seller in accordance with the Return Policy.


In the event of dispute, Pulimart will coordinate with You and the seller to reach an amicable solution.


Refusal of Delivery


Before accepting delivery of any product, kindly ensure that the product's packaging is not damaged or tampered. If You observe that the package is damaged or tampered, you are requested to refuse to accept delivery and inform Pulimart immediately note later than 2 days of delivery date.


You are requested to fill the delivery sheet / acknowledgement used by the logistics service providers and note down the condition of the delivered package. Damaged or tampered products claims will not be accepted beyond the returns policy


In the event of dispute, Pulimart will coordinate with You and the seller to reach an amicable solution.


 Delivery Time


An estimated delivery time of each product will be displayed on the [‘product order page’]. On placing Your order, you may receive an email or SMS at the email address or mobile number provided to Pulimart containing a summary of the order. The seller may take additional time to pack and dispatch certain products and this time may be included in the time indicated on the ‘product order page’.


Delivery timeframes are just estimates and are not guaranteed delivery timeframes and should not be relied upon as such. Deliveries to certain locations may take longer than expected due to accessibility of the location and serviceability by the logistics service provider.


 About Delayed Delivery


 Sometimes, delivery may take longer due to:


 



  1. Bad weather.

  2. Transportation delays.

  3. Natural calamities.

  4. Political disruptions.

  5. Logistics service provider related challenges.

  6. Product lost in transit.

  7. Regional or national holidays which are considered as delivery holidays.

  8. Other unforeseen circumstances or events beyond the control of Pulimart or logistics service provider.


 


If the estimated delivery date has passed and You still have not received Your order, please contact us and we will take steps to track Your package. In such cases, we may also try to proactively contact You. Please check Your emails and SMS regularly for such updates.


 Pulimart will not compensate for any mental agony or inconvenience or loss caused due to delay in delivery for any reason. You may be informed by email or SMS at the email address or mobile number provided to Pulimart if any product in the order is unavailable or is delayed or lost in transit.


Shipping Charges


You may be required to pay Shipping Charges in addition to the order value amount. The shipping charges, if any, will appear at the time of checkout. All delivery charges are inclusive of GST or any applicable taxes unless stated otherwise. Shipping Charges may vary for different pin code because of the increase in shipping cost or seller’s is located in a different area. Delivery charges will vary according to pin codes as well as type of product.


RETURN POLICY


 


 Reasons for Return


Return Policy makes it possible for You to return a product if You receive a damaged or defective product or if the product is significantly different from what was purchased or when the package delivered is missing one or more products or accessories. Return Policy here should be read in conjunction with the any specific terms and conditions applicable to a product which can be found on product descriptions page for returning a product.


 Conditions for Return


 In order to return any product sold through the Platform, you are required to comply with the below mentioned conditions, viz.:



  1. The return has to be in compliance with the Return Policy associated with the product category.

  2. Pulimart should be notified of the receipt of a damaged or defective product or if the product is significantly different from what was purchased, within period mentioned in the returns policy.

  3. Products should be returned unused, in their original packaging along with the original price tags, labels, packing, barcodes, user manual, warranty card and invoices, accessories, freebies and original boxes defined as essentials. If any product is returned without the essentials, the product shall not be accepted for return and shall be sent back to You.

  4. The return packages should be strongly and adequately packaged so that there is no damage of products during transit.

  5. The returned products are subject to verification and quality checks by the sellers selling on Pulimart in order to determine the legitimacy of the complaint or return.

  6. You should fill the Return Form provided by Pulimart with the originally delivered package or make available to You over email or mobile apps or account and include it in the returned package. Return requests are not processed if the Return Form is incomplete or absent in the returned package received. The reason for return should be stated in the Return form. You should additionally fill out the delivery sheet used by the logistics service providers and note down any damaged or tampered condition of the delivered package.

  7. The return has to be in compliance with the return policy of the seller or the manufacturer of the product where applicable.


 Non-returnable Products


 All products cannot be returned. Some of the products that cannot be returned are:



  1.                   Innerwear, lingerie, socks, clothing freebies and swimsuits.

  2. Perfumes, personal and beauty care or other consumables.

  3. Products that have been used or installed.

  4. Products damaged due to misuse of product or products having incidental damages due


          to malfunctioning.



  1. A product with defects not covered under manufacturer’s warranty.

  2. Products with tampered or missing serial numbers.

  3. Personalised or engraved products or resized products.   

  4. Product sold in sets or combination cannot be returned individually.

  5. Any other product depending upon the Return Policy in force.

  6. Software, Video Games (discs), printer cartridges.


 If You are unable to inform Pulimart of the receipt of a damaged or defective product or the product is not as per specifications of Your order or the package delivered is missing one or more products or accessories as per the returns policy and procedure, Pulimart or Seller shall not be obliged to accept the returned product or be liable in this regard. In the event, such product is sent to Seller, the product will be returned to the Customer and the same needs to be accepted from Seller or assigned logistics service provider. Pulimart or seller will not be responsible if the product is not accepted and no refund will be issued.


Damaged, Defective or Other Non-conforming Products


 


Returns of damaged, defective or other products eligible for return are accepted as under:


 



  1. In the event You receive a damaged or defective product or a product that does not comply with the specifications as per Your original or the product is delivered after the expected delivery period or the package delivered is missing one or more products or accessories and eligible for return as described by Return Policy, You are required to get in touch with the Customer Care Team through any of the below mentioned channels or submit a return request online (if such facility is available) as per the Returns Policy.

  2. Upon receiving Your return request, Pulimart shall verify the authenticity and the nature of the request and if the request is genuine, Pulimart will inform the seller of the return request and will ask the seller for a refund to be processed upon the receipt and quality check of the returned product. It will take a minimum of [ 2-15] business days to process Your request for return of products.


iii.     Pulimart or Seller may arrange for pick-up of the product through an assigned logistics service provider. You will receive an email or SMS notification at Your email address or mobile number provided to Pulimart. In the event Pulimart is unable to arrange pick-up, Pulimart will notify You regarding the same and You will be required to send the product to the seller at the provided address using a reputed courier service in Your area.



  1. For return of large and bulky products such as televisions, refrigerators, air-conditioners, etc. the seller will arrange for pickup.

  2. If Your pin code is not serviceable, Pulimart may ask You to ship the product to the seller or to pulimart using a relevant and available logistics service provider or Indian Postal services. Customers are required to submit the shipping information of the self-ship by contact Customer Service or email to customer.care@pulimart.com In the event the details are not provided and the shipment arrives without returns form or invoice, the refund may be delayed.

  3. Upon receipt of the returned product by the seller and successful completion of the quality check, you will receive an email or SMS confirmation at the email address or mobile number provided to Pulimart.  


vii.    You will be refunded the product cost along with taxes and shipping charges, if any. Courier freight charges You paid to courier or shipping service for returning the product to seller will be reimbursed as per method agreed with You.


 


You expressly acknowledge that the seller is solely responsible for the damaged or defective product or a product that does not meet the specifications of Your original order or delayed delivery of the order or delivery of the package with one or more products or accessories missing and for any claims that You may have in relation to such products and Pulimart shall not in any manner be held liable for the same except the case pulimart is the seller. In the event of dispute, Pulimart will coordinate with You and the seller to reach an amicable solution.


 


Dead on Arrival Products


 


In the event, You receive an electronic or technological product that is has manufacturing defect or is dead on arrival, You should inform Pulimart the period defined in the returns policy and place a request for return by following the procedure defined in the Returns Policy. You may be asked to obtain a manufacturer defect or Dead on Arrival certificate from the manufacturer or an authorised service centre of the manufacturer. This certificate will have to be produced to Pulimart for processing Your return request and sent to seller along with the product Pulimart may engage with a third party at its own discretion to help Customers obtain this certificate and cannot be held responsible for any delay or mishandling of products. If the products are found to be working or the defect is caused to any mishandling, product will be returned back to You. Customers are required to accept the return


 


In case a dead-on arrival certificate cannot be issued by an authorised service centre of the manufacturer, you will be required to get the product serviced or repaired as per warranty provided by the manufacturer and Pulimart will not be liable in any manner. In the event the certificate provided as dead on arrival certificate is disputed by the manufacturer or deemed as invalid, the product will be returned to You and Pulimart will not be liable in any manner.


 


Period for Return


 


Any return needs to be initiated within 10 days of the successful delivery of the product unless otherwise mentioned in the product details page. Please refer the section of the product information page for the Period of Return i.e. period within which a product delivered can be returned by the Buyer subject to the other terms and conditions of the Return Policy contained hereunder.


 


Cancellation of Return Request


 


A request for return once made can be cancelled by contacting Customer Service. In case the Logistics Service provider arrives to receive the shipment and You want to cancel the request, you may choose to inform the logistics service provider that You do not wish to return the product. You will receive an email or SMS notification at the email address or mobile number provided to Pulimart cancelling Your return request.


 


Refusal of Return Request


 


Pulimart reserves the right to refuse or cancel any return request.  If the request for returns is not allowed by the Returns Policy, you will not be refunded the payment made or any costs and will not be able to raise a second request for return for the same product. You agree not to dispute the decision made by Pulimart and accept Pulimart’s decision regarding the refusal or cancellation and further agree not hold Pulimart liable for any refusal or cancellation.


 


Frivolous Complaints


 


In the event of frivolous or baseless complaints or requests regarding the quality or content of the products, Pulimart reserves the right to take necessary legal actions against You and You will be solely liable for all costs incurred by Pulimart in this regard.


 


Return Shipping Process


 


Self-send Process


 


In case of return of products initiated and subsequent courier of the product by You, if it is found that the returned product was not delivered to the seller or any other designated location specified or the package was empty, the onus shall be on You to prove through submission of proof of delivery from the concerned courier service provider to establish Your claim of return. Self-courier of returns should be initiated within the periods specified in the Pulimart’s Returns Policy. Pulimart is not liable to process the return request until satisfactory proof of delivery is provided to Pulimart.


 


In case of damage claims, Pulimart may ask for pictures of the damaged product before it is approved or allowed for return.


 


For return shipping managed by Pulimart, you will need to hand over the product to the assigned logistics service provider at the time of pick-up. In the event the logistics service provider makes attempts to pick-up the product and You are unavailable or not ready to handover the product, Pulimart or logistics service provider will not be held responsible for the delay in pick-up or processing of the quality check by the seller and hence the refund. A maximum of 2 attempts will be made by the logistics service provider to pick-up the product to be returned. Pulimart will not be liable for the products returned by mistake.


 


In the event where a product not belonging to the seller selling on Pulimart is returned by mistake, Pulimart is not accountable for such misplacement and is not responsible for its delivery back to You or any costs incurred by You or any refund.


 


Discrepancy Between Information Provided by You and Our Logistics Service Provider


 


In case of any discrepancy in the status of pick-up of a product arranged by Pulimart, (where You claim the product has been returned, while our system suggests otherwise) refund will be initiated only if You successfully furnish the courier slip given by the Pulimart assigned logistics service provider at the time of the pick-up.


 


In case where a seller or designated return location claims that the product received from You is different or the return of the product is not in compliance with the Returns Policy, the product will be dispatched back to Your shipping address and You are required to receive and accept the package. In the event of dispute, Pulimart will coordinate with You and the seller to reach an amicable solution.


 


 


 


REFUND POLICY


 


Refunds


 


Refunds are provided for cancellation / return of products, subject to the eligible cancellation/ return as per Return Policy or these terms and conditions, initiated in accordance with the Return or Cancellation Policy.


 


Refund is made for the full amount of the order or part order successfully cancelled that was paid by You for the delivery of the order.


 


For return requests, the refund of payment is made after the returned product has been received by the seller and has passed the quality checks. The entire product cost along with any taxes and shipping charges if any will be refunded to You.


 


If any refund is received by You pending the quality checks, you will hold such amounts in trust on behalf of Pulimart until conclusion of such quality checks unless claimed by Pulimart any time before that. If You are in receipt of any wrongful refunded or payment, you will transfer such amount back to Pulimart within 3 days of You receiving such amount.


 


No refund due to non-deliverability will be applicable to orders placed with Cash on Delivery options. Refund of Cash on Delivery orders returned by You may subject to levy of a charge which will be deducted from Your refund amount.


 


Time Period for Refunds


 


Refunds are normally processed within 1-15 working days after the completion of quality checks of product returned and further depends on various banking and payment channels.


Interest charged by the bank providing the EMI Scheme till the time the request for return or cancellation is raised will not be refunded. 


 


Pulimart is not responsible for any errors or delays in refund due to banks or third-party service provider errors or delays.


 


Mode of Refund


 


The mode of refund of payments cannot be changed at any stage as the refund amount is transferred to Your source account. Refunds are paid back to the source of payment.


 


Refund for payments made by modes other than Cash on Delivery, which fail when processed back to source may be refunded to Your bank account.


 


Refund of orders placed using Cash on Delivery as the payment method will be made by cheque or demand draft or to Your bank account via NEFT depending on the discretion of Pulimart.


 


You will need to update the bank account number and IFSC code to enable us to process a refund to Your account. Refunds cannot be processed to third-party accounts, i.e. the name on Your Pulimart account should match with the name of the bank account holder provided for refund via NEFT. A refund initiation confirmation by email or SMS at the email address or mobile number provided to Pulimart will be sent to You. A refund detail may be updated in ‘My order page’ under the respective order.


 


All refunds by cheque will be in form of "at par" cheques or via online transfer; basis sole discretion of Pulimart.


 


Terminated Payment Mode


 


If the original payment method You used to make the payment (credit or debit card or net banking) is no longer valid, we will issue the refund through a cheque. When we receive a payment failure notice from Your bank, we will send You an email asking You to call us. When You call us, we will collect Your address where You want the cheque to be sent, and proceed with the refund. Please refer to our Payment Policy for further details.


 


You explicitly give Your consent to receiving communications (by SMS, email or other mode of communication) sent to You by Pulimart, however, you may withdraw Your consent any time at Your sole discretion.


 


 


 


Listing of Products


 


Pulimart through the Platform makes available a variety of branded products and merchandise of the sellers for sale to buyers. Sellers who have agreed to sell their products on the Platform list their products on the Platform. Purchase and sale of such products will be subject to these Terms.


 


All product and price information, deals and offers related to the products are provided by the seller to Pulimart for inclusion on the Platform and the sellers are solely responsible for the accuracy of the information, validity of the prices, charges, deals, offers and other information relating to the products offered on the Platform. Separate contracts govern the relationship between Pulimart and sellers for display and sale of their products on the Platform. These Terms do not govern and are not Platform Applicable to (and do not amend or modify) the relationship and arrangement between Pulimart and such sellers as set forth in such separate contracts.


 


Pulimart does not endorse or warrant the quality, quantity, stability, use, price or other specifications of the products offered for sale by the sellers and purchased by buyers on the Platform or for any defects, deficiencies, shortcomings, errors or omissions in relation to the products except the case pulimart as a seller. Please make sure You have read the product listing information before placing an order.


 


 


 


Delivery


 


The seller delivers the ordered products either directly or by availing the services of the platform through its logistics service providers in terms of the Delivery Policy. The Platform may change the Delivery Policy without any notice. For more details, please review the Delivery Policy.


 


Pricing, Promotions & Coupon Codes


 


Pricing Information


 


All prices are inclusive of GST and applicable taxes unless stated otherwise. The price of products offered by the seller on the Platform is either equal to or lesser than the Maximum Retail Price ("MRP") i.e., the discounted rate prescribed for those products. The MRP and other statutory declarations will be mentioned on the products or on its packaging in accordance with applicable laws. Sellers may or may not specify this information on the Platform, and You are advised to independently determine the MRP of such products if You so desire. 


 


While Pulimart shall endeavour to provide accurate product and pricing information, yet typographical errors might occur. Pulimart cannot confirm the price of a product until after you order. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, Pulimart shall have the right, at our sole discretion, to refuse or cancel any orders placed for that product, unless the product has already been dispatched. In the event that an item is mis-priced, Pulimart may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Unless the product ordered by you has been dispatched, your offer will not be deemed accepted and Pulimart will have the right to modify the price of the product and contact you for further instructions using the e-mail address or mobile number provided by you during the time of registration, or cancel the order and notify you of such cancellation. In the event that Pulimart accepts your order the same shall be debited to your credit card account and duly notified to you by email that the payment has been processed. The payment may be processed prior to Pulimart dispatch of the product that you have ordered. If we have to cancel the order after we have processed the payment, the said amount will be reversed back to your credit card account.


 


Promotion Offers


For any returned or undelivered orders, partial or whole, the user will not be eligible to avail of the offer used to purchase the original order. The benefit of the offer would also not be included in the refund provided. If the product(s) returned are part of any free offer, Eg: Buy 2 get 1 free or Buy 1 get 1 free, all the products related to the offer would have to be returned by you, as they have been purchased as part of a group offer. The refund/replacement process would only be initiated once all the products have been returned. 
From time to time, we may provide a free sample or gift along with our orders which are eligible for the offer. These samples/gifts will not be eligible for return/replacement/refund under any circumstances.


 


Coupon Code Cash back disocunts


 


To offer special discounts to our users from time to time, we share coupon codes-based cash back. To prevent any possible misuses, we have put in place a few checks on the ways in which these coupon codes can be used. 



To make the best use of the coupon code offers, please go through the following terms and conditions applicable on all coupon codes


 



  1. Coupon Codes based offers will be valid upon application of the coupon code at the time of placing order.

  2. Coupon Codes will be valid till the date communicated or till stocks last on the applicable products, whichever happens earlier.

  3. Coupon Codes will not be valid on certain products which will be listed in platform

  4. A Coupon Codes can be used only once per user unless otherwise mentioned.

  5. A Coupon Codes cannot be clubbed with any other coupon code or with any other offer including offers running on the Platform without using coupons unless otherwise mentioned.

  6. Coupon codes shared individually with a user will be applicable on purchase made by that particular user only unless otherwise mentioned.

  7. The website reserves the right to change the terms and conditions of any coupon code any time without prior intimation.

  8. Shipping / Cash on delivery rules and charges apply on the net amount payable upon application of the coupon code unless otherwise mentioned.

  9. Cashback coupons are valid for next purchase as per the conditions mentioned with the Cashback offer.

  10. The Cash back Coupons added to an account can be changed/updated at any point of time by Pulimart without any prior intimation. These changes could be made from time to time even before the valid expiry date of the existing Cash back Coupons.


11.Cashback will not be provided for any product(s) which have either not been delivered to you or which has been returned or cancelled by you. For any cancelled or returned or undelivered orders, partial or whole, the user will not be eligible for any cashback, the entire cash back will be cancelled any of the product from the order has been returned.



  1. The company reserves the right to change the terms and conditions of the Cashback offers without prior intimation

  1. Cashback will be earned on purchases on the products mentioned in the cashback promotions.


16.Cashback will be earned upon the satisfactory completion of the conditions and upon expiry of the return period

Transactions, Return & Cancellations


 


Credit or Debit Card Details


 


You hereby agree, understand and confirm that the credit or debit card details provided by you for availing of services on platform will be correct, accurate and current. Under no circumstances you shall use a credit card which is not lawfully owned by you. You further agree and undertake to provide the correct and valid credit or debit card details to us. The card details will not be utilised and shared by us with any of the third parties unless required for fraud verifications or by law, regulation or court order. We will not be liable for any credit or debit card fraud. The liability for use of a card fraudulently will be on you and the onus to 'prove it otherwise' shall be exclusively on you.


 


Fraudulent /Declined Transactions


 


In case of fraudulent use of the site or platform, we reserve the right to recover the cost of goods, collection charges and lawyers’ fees from person(s) concerned. We reserve the right to initiate legal proceedings against such person(s) for fraudulent use of the Site and any other unlawful acts or acts or omissions in breach of these terms and conditions.


Cancellations by the Customer


In case we receive a cancellation notice and the order has not been shipped by us, we shall cancel the order and refund the entire amount. The orders that have already been shipped out by us will not be cancelled and you will have to check our return policy on those orders.


 


Cancellation by Pulimart


 


Under certain circumstances it might not be possible for us to accept an order and we may be compelled to cancel the same. We reserve the right to refuse or cancel any order for any reason at our sole discretion. Some situations that may result in your order being cancelled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also ask for additional verifications or information before accepting any order. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your credit card has been charged, the said amount will be Refunded to your same account. The customer agrees not to dispute the decision made by us and accept our decision regarding the cancellation.


 


Returns & Cancellation


All products which are not delivered to You or returned by You in accordance with the Return Policy will be returned to the seller of the products except the case pulimart is the seller.


 Return and cancellation of the products may be initiated in accordance with the Platform policies. Please review the Returns Policy and Cancellation Policy as applicable to the products purchased by You. The Platform may change the Returns Policy and Cancellation Policy without any notice.

While availing any of the payment method/s offered by us, we are not responsible or take no liability of whatsoever nature in respect of any loss or damage arising directly or indirectly to you out of the decline due to:




  1. lack of authorization for any transaction/s, 
    2. or exceeding the preset limit mutually agreed by you and between your "Bank/s", 
    3. or any payment issues arising out of the transaction,
    4. or decline of transaction for any other reason/s. 


All payments made against the purchases/services on Pulimart by you shall be compulsorily in Indian Rupees acceptable by the Union of India. Pulimart does not accept any other form of currency with respect to the purchases.
Before shipping your order to you, we may request you to provide supporting documents (including but not limited to Govt. issued ID and address proof) to establish the ownership of the payment instrument used by you for your purchase. This is done in the interest of providing a safe online shopping environment to our users.


 


Issues with Payments - Pending Payments:


 


Payments can sometimes fail or remain in the pending stage. Some of the reasons could be:


 



  1.  Incorrect debit or credit card details are entered.

  2. Card may be blocked or card details are no longer valid or need to be updated.


3    The page is accidentally closed or refreshed or backspace is pressed while the transaction is being processed by Your bank.



  1. The connection between Pulimart and Your bank or issuer failed due to some technical reasons and the transaction could not be completed.

  2. Card or bank or issuer is not recognised by Pulimart.

  3. Incorrect login or password details are entered.

  4. Payment amount exceeds the limit mutually agreed to between You and Your bank or issuer.


If You face any of the above payment issues, try placing the order again in a short while or contact Your bank or issuer for technical assistance. Pulimart is not liable for any loss or inconvenience caused to You when making payment or for any wrongful debits to Your cards or net banking accounts.


 


 


 


Issuing Bank Terms and Conditions


 


Users understand and acknowledge that all payments made by the Users using valid credit card/ Debit card/ Cash Card/ and other payment instruments or mechanism including net banking facility will be processed using a payment gateway or appropriate payment system infrastructure and the same is governed by a separate set of terms and conditions agreed between the User and the respective Issuing Bank and payment instrument issuing company.


 


Requirements of Permanent Account Number (PAN)


 


For all the purchase of an amount equal to or exceeding INR 2,00,000 (INR two lakhs only), You will be required to upload a copy of Your PAN card, within such time as may be prescribed from the date of purchase, failing which, the purchase made by You will be automatically cancelled. The order shall also stand cancelled if there is a discrepancy between Your name in Account with Pulimart the name printed on the PAN card.


 


The requirement to provide a copy of PAN card is one-time activity and You don’t need to submit it again.

You Agree and Confirm


 


1.That you will use the services provided by Pulimart, its affiliates, consultants and contracted companies, for lawful purposes only and comply with all applicable laws and regulations while using the Site and transacting on the Site. 
2. You will provide true, accurate, complete and current information in all instances where such information is requested of you. Pulimart reserves the right to confirm and validate the information and other details provided by you at any point of time. If upon confirmation your details are found not to be true (wholly or partly), Pulimart has the right in its sole discretion to reject the registration and debar you from using the Services of Platform and / or other affiliated websites without prior intimation whatsoever. 
3. To compensate Pulimart for any extra cost incurred for redelivery in the event of a non-delivery in the first instance on account of a mistake by you (i.e. wrong name or address or any other wrong information). 
4. That you using your best and prudent judgment before entering into any transaction through this Site doing so at your sole risk. 
5. After placing an order for a product you agree to be bound by the conditions of sale included in the item's description.



  1. If you are using the platform as referred by a referrer you are agree to abide by the terms and conditions set forth in the ‘Refer and Earn Program Agreement’ and all Relevant Rules of the platform. Each party will not use the other party's confidential information, except as necessary for the performance of the agreement, and will not disclose such confidential information to any third parties, except to those of its officers, directors, employees, referrer and agents that need to know such confidential information for the performance of the ‘Refer and Earn Program’ Agreement. The foregoing obligations will not restrict either party from disclosing the other party’s confidential information if pursuant to the order or request of a court, administrative agency, or other governmental body, provided that the party required to make such a disclosure gives reasonable written notice to the other party to enable it to contest such order or request.

  2. Transmitting material that encourages conduct that results in civil liability or otherwise breaches any relevant laws, regulations or code of practice or constitutes a criminal offence.

  3. Gaining unauthorised access to other computer systems.

  4. Interfering with any other person's use or enjoyment of the Site.

  5. Breaching any applicable laws.

  6. Interfering or disrupting networks or web sites connected to the Site.

Refer and Earn Program Rules and Policies


This Program Membership Agreement (“Agreement”) explains the terms and conditions that govern your participation in the Refer and Earn Program ("Program"). This Agreement is between the Applicant (“You”) and PULIMART STORES PRIVATE LIMITED. It is your responsibility to read and understand the terms and conditions of this Agreement. By referring a person and becoming as a member in the Program ("Member"), you agree to be bound by these Program Terms of Use and the Privacy Policy of Pulimart.


 



  1. Program Overview


 



  1. This is an exclusive Pulimart program designed to reward Pulimart users (“Referrer”) for the qualified purchases made by the customer(‘Referee) who has been referred by the users (Referrer”) to the Pulimart platform. The Program is available on the Pulimart Mobile Apps and cannot be used in case of products being purchased from third party sites.
    2. Participation in the Program and the benefits that are offered to Program members is at the sole discretion of Pulimart Stores Private Limited, and we have the right to change the respective Program terms and conditions, in whole or in part, at any time with or without giving any notice to its Members.
    3. Program is available only to retail customers who are transacting on Pulimart Platform and would not be available to any wholesale/ third party customers purchasing any Pulimart product(s). .


 


 



  1. Eligibility


 



  1. You must be of legal age (18 years) to qualify for membership in the Program.
    2. Members must be human: no machines, scripts, or automated services may be used to participate in this program.
    3. You may require to submit the ID proof to participate the program.



III. Earning Referral Commission


 


1.You become a part of this program automatically on referring the people and accepting the policy of Pulimart Refer and earn program



  1. Refer and earn commission is a reward provided for the platform users who are supporting by referring the platform to the new people and however Pulimart has all the right not to provide or refuse to credit the commission to wallet or hold or block until the time Pulimart or company decide, if any misconduct or breach of policy is noticed from the side of platform users.


3.Cancelled / Returned orders shall not be eligible for Referral commission provided under Refer and Earn program
3. Referral commissions are eligible only when a referee make a qualifying purchase. ("Qualifying purchases" means purchase completed by buyer on the platform site as instructed in the Platform site. A purchase shall only be deemed to be "completed" by a buyer if the buyer has taken the requisite steps required by the platform site for acknowledging transactions completion. For the avoidance of doubts, transactions on the platform site that are returned or refunded by the buyer shall not be qualifying purchases)


4.When a referee makes qualifying purchases, commission amount as specified and listed in the pulimart.com website, shall be transferred to the Member (the referrer). The commission amount would be credited to the Pulimart internal ‘wallet’ available in the user account within 48 hours of successful completion of the return period.


 


5.Platform shall have the right, in its sole discretion to amend and restate any Relevant Rules or policy from time to time (the "Amended and Restated Relevant Rules”) without notification to the participant. All amended and Restated Relevant Rules shall become effective immediately upon its publication on the Platform portal or platform site. Participants logging-in to the Platform Portal and /or continuance of the participation in the programme after the publication of the Amended and Restated Relevant Rules shall be deemed as consent on the part of Participant to accept and be bound by the Amended and Restated Relevant Rules.


6.The Programme is intended to provide Participant with the opportunity to share pre-approved Platform link by sharing it to friends or relatives in accordance with instructions given on the Platform Site. Platform will make available to Participant the Platform link to be shared and/or advertised by participant pursuant to the program. Platform will reward the participant the corresponding referral commission for qualifying purchases made by a buyer in accordance with Clause terms and conditions of this Agreement.



  1. Under the Programme, Participant may only share the pre-approved Platform link, and shall not intentionally or unilaterally misrepresent, alter or misstate the Platform link. Participant may not authorize or assign his or her rights under this Agreement to any third party to share the Platform link.

  2. Platform reserves the right to reject Participant's application for participation in the Programme determines that, in its sole and absolute discretion, Participant is unsuitable for participation in the Programme.

  3. Platform will make available to participant on the Platform Portal: records relating to the Qualifying Purchases.

  4. Participant agrees that all performance of Participant advertisement of Platform link or content may be recorded and tracked by Platform. The records tracked and stored by platform shall serve as the basis for calculating the sum of referral commission payable to Participant under the programme.

  5. Participant shall not use any means or technology to conduct activity which involves Fraud (actual or purported). Platform shall have the right to determine and declare, in its sole and absolute discretion, such Fraud activities to be invalid and Platform shall not be charged for such Fraud activities.

  6. Participant shall be responsible for his or her participant Site/Media and ensure that: the technical operation of the participant Site/media is secure;


the content/information displayed on the participate Site/media regardless of whether Platform Content is included ,is:


in compliance with the terms of this Agreement as well as the Relevant Rules;


in compliance with any applicable laws and regulations, including but not limited to laws and regulations that governing the sending of unsolicited electronic commercial messages;


not infringing any legitimate rights, including but not limited to intellectual Property Rights,of any third party,


not containing either discriminatory, defamatory, profane, obscure content, or any adult age-restricted content.


Platform shall not be liable for any matters that arise out of Participant's breach of this Agreement


Participant shall be responsible for all activities on his or her account with the platform Portal and for loss, theft or unauthorized disclosure of its password. Participant shall provide prompt notification to Platform of any known or suspected unauthorized use of his or her account or breach of the security of its account on the Platform Portal.



  1. As consideration for qualifying purchases by referee under this Agreement, participant (the referrer) shall be entitled to a certain pre-approved percentage ("commission Rate") of the value of each qualifying purchases("Earning") in the form of commission as may be announced or published by the Platform site from time to time. Details of the commission Rate and earnings applicable to a Participant for each product shall be such commission terms published on Pulimart.com website. However, earning for any qualifying purchase for platform products may not exceed INR10,000/-for instance.


14.Participant (the referrer) shall be able to request to transfer the commission to the bank account only when it is reach INR10,000/- or shall be able to move the commission earned to the pulimart internal ‘wallet’ available in the user account any time. Participant shall use the wallet balances for purchasing the product from our platform. You will not be able to accumulate the earned commission more than INR10,000 at a time, you will need to either request the platform to transfer INR10,000 to your bank account or move the earned commission to the Pulimart Internal ‘Wallet’ for using the balance for purchases in our platform, there after you will be able to earn the referral commission again as in the same process will continue .


 


15.You will need to update the bank account number and IFSC code to enable us to process a transfer of commission to Your account. Transfer cannot be processed to third-party accounts, i.e. the name on Your Pulimart account should match with the name of the bank account holder provided for transfer of commission earned which is amounted INR10,000. A transfer initiation confirmation by email or SMS at the email address or mobile number provided to Pulimart will be sent to You.


 



  1. Accrued earning will be shown on participant's Account on Platform Portal as "Earnings" but such amount shall only be regarded as an estimate which is subject to adjustment due to any breach by participant of the Agreement or Relevant Rules, charge back by Platform in accordance with this Agreement ,and/or any addition or deletion of Qualifying Purchases for the month as corrected by platform's tacking system and technology.

  2. Platform reserves the right to update the commission Rate and/or commission terms from time to time without notification to You. Your continued participation/sharing via Platform Portal after publication of the Amended and Restated Terms shall be deemed as your acceptance of the amended and restated terms. In the event of dispute concerning the amount of Earnings payable to a Participant, the records of the ‘company’ shall always be conclusive, final and binding.


18.Settled earning may be moved to pulimart internal ‘wallet’ and can be used to redeem /purchase pulimart.com products, for avoidance of misunderstanding, the minimum denomination of pulimart.com wallet balance is 1(one)INR., Therefore, you may not redeem/exercise pulimart.com values when your earning is lower than 1(one)INR


19.Platform shall have the right to chargeback any Fraud, invalid Qualifying Purchases ("Disqualified Entries”) in accordance with this Agreement, regardless if the Earnings for such Disqualified Entries is settled or not. Platform shall be entitled to either


(i)set off the amount of the Earning for such Disqualified Entries against the amount of the Earning payable to Participant following the detection of the Disqualified entries;(ii) request participant to return the amount of the Earning for such Disqualified Entries (even following the termination of this agreement); or(iii)deduct the amount of the commission for such Disqualified entries from the balance on Participants account on the Platform Portal.


20.Participant shall bear all the applicable taxes, costs and expenses (including but not limited to any handling fees charged by banks and any technical service fees charged by Platform) in connection with the payment of commission by Platform to Participant. The amount of such technical service fees as published on the Platform portal from time to time shall apply.



  1. Except as expressly agreed to in writing by the Parties, Platform and Pulimart stores pvt Ltd will own all the right, title and interest in and to all copyrights,inventions,improvements,products,services,technology,informations and materials, work product or derivatives of any kind that Participant may independently create, develop or prepare during the term, including all worldwide intellectual Property Rights and proprietary right there in, including without limitation entire content of texts,software,audios,pictures,videos,graphics,logos,layout,design,advertisemnt and promotional material produced for the purpose of fulfilling Participant’s obligations under this Agreement.

  2. as provided in this Agreement, Participant agrees not to transfer, copy, modify, alter, adapt or create derivative works based on the materials approved by Platform and Pulimart Stores pvt ltd without obtaining their respective written consents.


23.Participant is not allowed to use, apply for registration, or register such items identical with or similar to any trademarks, registered or unregistered, tradenames, logos and domain names of Platform, its affiliate or the Platform Site including pulimart.com



  1. Participant shall not copy or modify any icons, buttons, banners, graphics files, or Platform content that Platform has made available unless otherwise agreed by Platform in writing.

  2. Except as expressly agreed to in writing by the Parties, nothing in this Agreement will be deemed to grant or assign to the either party any ownership rights, license rights, or interests of any kind in the other Party's products, services or technology or in the other Party's intellectual Property Rights or proprietary rights.


26.Each party will not use the other party's confidential information, except as necessary for the performance of this agreement, and will not disclose such confidential information to any third parties, except to those of its officers, directors, employees and agents that need to know such confidential information for the performance of this Agreement. The foregoing obligations will not restrict either party from disclosing the other party’s confidential information if pursuant to the order or request of a court, administrative agency, or other governmental body, provided that the party required to make such a disclosure gives reasonable written notice to the other party to enable it to contest such order or request.


27.Each party represents and warrants that:


(a)It will take no false or misleading representations, warranties or guarantees with respect to the other party and all material aspects of the other party's business including but not limited to its products and services


(b)It has authority and capacity to enter into this Agreement and it is not subject to any restrictive covenant or other legal obligations which prohibits it from performing its obligations hereunder.


(c)It shall perform its obligations under this Agreement in a timely and efficient manner and with reasonable care and skill


(d)it will comply with all applicable laws and regulations and will maintain any permits, license and approvals required to perform its obligations hereunder.


28.Participant further represents, warrants and/or covenants that:


(a)all information provided to platform during its registration process on the Platform Portal is true, complete and accurate.


General Information

General Information


Accessing, browsing or otherwise using the Platform will be construed as Your unequivocal and irrevocable acceptance and acknowledgement to the terms and conditions contained under Terms of Use and binding policies hereof. By using the Platform to have carefully read, understood and agree to be bound by these Terms of Use. Pulimart may at its sole discretion allow or disallow access to Platform and reserves the right to change any of the terms and conditions contained herein at any point in time. It is Your responsibility to periodically review these Terms of Use any update and changes and Your continued use of the Platform will be considered as Your acceptance to such updates and changes.


 ELIGIBILITY


You should have completed 18 years of age and be competent to enter into a contract under Indian contract law. If You are under 18 years of age who is intending to avail the services of the Platform should do so through Your legal guardian in accordance with applicable law. 


If You are using the Platform on behalf of any corporation, company, institution, association or other entity, the person should be authorized by such corporation, company, institution, association or other entity to use and access the App.


Pulimart reserves the right to refuse access to use the services offered at the Platform to new users or to terminate access granted to existing users at any time without according any reasons for doing so.


 COMPLIANCE REQUIREMENTS


 Every User of the Platform shall comply with all the applicable laws, including but not limited to the Foreign Exchange Management Act, 1999, notifications issued there under the Exchange Control Manual issued by the Reserve Bank of India, Customs Act, 1962, Information Technology Act, 2000, Prevention of Money Laundering Act, 2002, Foreign Contribution Regulation Act, 1976, Income Tax Act, 1961, Export Import Policy of the Government of India and shall include any amendments, notifications and Rules thereof under the aforesaid enactments applicable for using the App or buying/ selling any product or service through the Platform.


 Account and Registration


It is the user's responsibility to keep the details of the account and password confidential and you agree to accept responsibility for all activities that occur under Your Account or Password. Pulimart shall not be liable to any person for any loss or damage which may arise as a result of any failure by the user to protect the account details or the password. In case of any suspected breach please contact us immediately. If Pulimart has reason to believe that there is likely to be a breach of security or misuse of the Pulimart Platform, we may require you to change your password or we may suspend your account without any liability to Pulimart. 
You also agree to:
1. Provide true, accurate, current and complete information about yourself as prompted by Platform during the registration process (such information being the "Registration Data". e.g. like email address or mobile number etc)
2. Maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, incomplete, or not current or if Pulimart has reasonable grounds to suspect that such information is untrue, inaccurate, not current or not in accordance with the User Agreement, Pulimart will have the right to indefinitely suspend or terminate your membership and refuse to provide you with access to the Site.

Shipping Charges

 Shipping Address


 Your shipping address and pin code will be verified with the database of Pulimart before You proceed to pay for Your purchase. In the event Your order is not serviceable by our logistics service providers or the area is not covered, we will request You to provide us with an alternate shipping address. You can make purchases on the Platform from anywhere in the world but at the same time You must ensure the payment and shipping address is within India.


 


When You submit an alternative address for delivery, you are responsible for accepting and collecting the package from such alternative address. Confirmation from the logistics service provider of successful delivery to the alternative shipping address is deemed as acceptance of delivery by You and Pulimart will have no liability in this regard.


 Delivery by Pulimart or Seller


The delivery of the ordered products from the seller to You will be made by logistics service providers assigned by Pulimart or Sellers. However, large and bulky products such as televisions, refrigerators, air-conditioners, furniture etc. may be delivered to You directly by the seller. Deliveries cannot be rescheduled after the order has been placed.


The logistics service provider assigned by Pulimart will make a maximum of three [3] attempts to deliver Your order. In case You are not reachable, available or do not accept delivery of products in these attempts Pulimart reserves the right to cancel the order at its discretion. You may be informed of such cancellation by email or SMS at the email address or mobile number provided to Pulimart. The cancelled order is returned to seller. You agree not to hold Pulimart liable for any cancellation.


 If You wish to request the Platform to resend the product, you can do so by placing a new order for the product on the terms set out on the [‘product order page’] when You place the new order. Your order will be accepted subject to availability of the product.


 In case there is any dispute regarding the shipment of the product or serviceability for the area not covered by the logistics service providers, Pulimart will not be responsible for the non-delivery of the product.


Title and risk of loss for all products ordered by You shall pass on to You upon delivery of the products at the shipping address provided by You.


 Multiple Product Orders


 In case You order multiple products in one transaction, Pulimart would endeavour to ship all products together. However, this may not always be possible due to some product characteristics or logistics issues or the location of seller and You may receive the products separately and at different times. If You purchase multiple products in a single transaction, then all the products would be dispatched to a single shipping address given by You. If You wish to ship products to different addresses, then You should book the orders separately based on the shipping addresses.


 Missing Items


 In the event, the product package received by You is missing one or more products or accessories or does not include the freebie or the order is partly delivered, you should inform Pulimart through the Customer Care Team within 2 days of delivery date of the package. Missing products claims will not be accepted after 2 days from delivery date.


When a package delivered is missing one or more products or accessories, you are requested to return the original package delivered to the seller in accordance with the Return Policy.


In the event of dispute, Pulimart will coordinate with You and the seller to reach an amicable solution.


Refusal of Delivery


Before accepting delivery of any product, kindly ensure that the product's packaging is not damaged or tampered. If You observe that the package is damaged or tampered, you are requested to refuse to accept delivery and inform Pulimart immediately note later than 2 days of delivery date.


You are requested to fill the delivery sheet / acknowledgement used by the logistics service providers and note down the condition of the delivered package. Damaged or tampered products claims will not be accepted beyond the returns policy


In the event of dispute, Pulimart will coordinate with You and the seller to reach an amicable solution.


 Delivery Time


An estimated delivery time of each product will be displayed on the [‘product order page’]. On placing Your order, you may receive an email or SMS at the email address or mobile number provided to Pulimart containing a summary of the order. The seller may take additional time to pack and dispatch certain products and this time may be included in the time indicated on the ‘product order page’.


Delivery timeframes are just estimates and are not guaranteed delivery timeframes and should not be relied upon as such. Deliveries to certain locations may take longer than expected due to accessibility of the location and serviceability by the logistics service provider.


 About Delayed Delivery


 Sometimes, delivery may take longer due to:


 



  1. Bad weather.

  2. Transportation delays.

  3. Natural calamities.

  4. Political disruptions.

  5. Logistics service provider related challenges.

  6. Product lost in transit.

  7. Regional or national holidays which are considered as delivery holidays.

  8. Other unforeseen circumstances or events beyond the control of Pulimart or logistics service provider.


 


If the estimated delivery date has passed and You still have not received Your order, please contact us and we will take steps to track Your package. In such cases, we may also try to proactively contact You. Please check Your emails and SMS regularly for such updates.


 Pulimart will not compensate for any mental agony or inconvenience or loss caused due to delay in delivery for any reason. You may be informed by email or SMS at the email address or mobile number provided to Pulimart if any product in the order is unavailable or is delayed or lost in transit.


Shipping Charges


You may be required to pay Shipping Charges in addition to the order value amount. The shipping charges, if any, will appear at the time of checkout. All delivery charges are inclusive of GST or any applicable taxes unless stated otherwise. Shipping Charges may vary for different pin code because of the increase in shipping cost or seller’s is located in a different area. Delivery charges will vary according to pin codes as well as type of product.

RETURN POLICY

Reasons for Return


Return Policy makes it possible for You to return a product if You receive a damaged or defective product or if the product is significantly different from what was purchased or when the package delivered is missing one or more products or accessories. Return Policy here should be read in conjunction with the any specific terms and conditions applicable to a product which can be found on product descriptions page for returning a product.


 Conditions for Return


 In order to return any product sold through the Platform, you are required to comply with the below mentioned conditions, viz.:



  1. The return has to be in compliance with the Return Policy associated with the product category.

  2. Pulimart should be notified of the receipt of a damaged or defective product or if the product is significantly different from what was purchased, within period mentioned in the returns policy.

  3. Products should be returned unused, in their original packaging along with the original price tags, labels, packing, barcodes, user manual, warranty card and invoices, accessories, freebies and original boxes defined as essentials. If any product is returned without the essentials, the product shall not be accepted for return and shall be sent back to You.

  4. The return packages should be strongly and adequately packaged so that there is no damage of products during transit.

  5. The returned products are subject to verification and quality checks by the sellers selling on Pulimart in order to determine the legitimacy of the complaint or return.

  6. You should fill the Return Form provided by Pulimart with the originally delivered package or make available to You over email or mobile apps or account and include it in the returned package. Return requests are not processed if the Return Form is incomplete or absent in the returned package received. The reason for return should be stated in the Return form. You should additionally fill out the delivery sheet used by the logistics service providers and note down any damaged or tampered condition of the delivered package.

  7. The return has to be in compliance with the return policy of the seller or the manufacturer of the product where applicable.


 Non-returnable Products


 All products cannot be returned. Some of the products that cannot be returned are:



  1.                   Innerwear, lingerie, socks, clothing freebies and swimsuits.

  2. Perfumes, personal and beauty care or other consumables.

  3. Products that have been used or installed.

  4. Products damaged due to misuse of product or products having incidental damages due


          to malfunctioning.



  1. A product with defects not covered under manufacturer’s warranty.

  2. Products with tampered or missing serial numbers.

  3. Personalised or engraved products or resized products.   

  4. Product sold in sets or combination cannot be returned individually.

  5. Any other product depending upon the Return Policy in force.

  6. Software, Video Games (discs), printer cartridges.


 If You are unable to inform Pulimart of the receipt of a damaged or defective product or the product is not as per specifications of Your order or the package delivered is missing one or more products or accessories as per the returns policy and procedure, Pulimart or Seller shall not be obliged to accept the returned product or be liable in this regard. In the event, such product is sent to Seller, the product will be returned to the Customer and the same needs to be accepted from Seller or assigned logistics service provider. Pulimart or seller will not be responsible if the product is not accepted and no refund will be issued.


Damaged, Defective or Other Non-conforming Products


 


Returns of damaged, defective or other products eligible for return are accepted as under:


 



  1. In the event You receive a damaged or defective product or a product that does not comply with the specifications as per Your original or the product is delivered after the expected delivery period or the package delivered is missing one or more products or accessories and eligible for return as described by Return Policy, You are required to get in touch with the Customer Care Team through any of the below mentioned channels or submit a return request online (if such facility is available) as per the Returns Policy.

  2. Upon receiving Your return request, Pulimart shall verify the authenticity and the nature of the request and if the request is genuine, Pulimart will inform the seller of the return request and will ask the seller for a refund to be processed upon the receipt and quality check of the returned product. It will take a minimum of [ 2-15] business days to process Your request for return of products.


iii.     Pulimart or Seller may arrange for pick-up of the product through an assigned logistics service provider. You will receive an email or SMS notification at Your email address or mobile number provided to Pulimart. In the event Pulimart is unable to arrange pick-up, Pulimart will notify You regarding the same and You will be required to send the product to the seller at the provided address using a reputed courier service in Your area.



  1. For return of large and bulky products such as televisions, refrigerators, air-conditioners, etc. the seller will arrange for pickup.

  2. If Your pin code is not serviceable, Pulimart may ask You to ship the product to the seller or to pulimart using a relevant and available logistics service provider or Indian Postal services. Customers are required to submit the shipping information of the self-ship by contact Customer Service or email to customer.care@pulimart.com In the event the details are not provided and the shipment arrives without returns form or invoice, the refund may be delayed.

  3. Upon receipt of the returned product by the seller and successful completion of the quality check, you will receive an email or SMS confirmation at the email address or mobile number provided to Pulimart.  


vii.    You will be refunded the product cost along with taxes and shipping charges, if any. Courier freight charges You paid to courier or shipping service for returning the product to seller will be reimbursed as per method agreed with You.


 


You expressly acknowledge that the seller is solely responsible for the damaged or defective product or a product that does not meet the specifications of Your original order or delayed delivery of the order or delivery of the package with one or more products or accessories missing and for any claims that You may have in relation to such products and Pulimart shall not in any manner be held liable for the same except the case pulimart is the seller. In the event of dispute, Pulimart will coordinate with You and the seller to reach an amicable solution.


 


Dead on Arrival Products


 


In the event, You receive an electronic or technological product that is has manufacturing defect or is dead on arrival, You should inform Pulimart the period defined in the returns policy and place a request for return by following the procedure defined in the Returns Policy. You may be asked to obtain a manufacturer defect or Dead on Arrival certificate from the manufacturer or an authorised service centre of the manufacturer. This certificate will have to be produced to Pulimart for processing Your return request and sent to seller along with the product Pulimart may engage with a third party at its own discretion to help Customers obtain this certificate and cannot be held responsible for any delay or mishandling of products. If the products are found to be working or the defect is caused to any mishandling, product will be returned back to You. Customers are required to accept the return


 


In case a dead-on arrival certificate cannot be issued by an authorised service centre of the manufacturer, you will be required to get the product serviced or repaired as per warranty provided by the manufacturer and Pulimart will not be liable in any manner. In the event the certificate provided as dead on arrival certificate is disputed by the manufacturer or deemed as invalid, the product will be returned to You and Pulimart will not be liable in any manner.


 


Period for Return


 


Any return needs to be initiated within 10 days of the successful delivery of the product unless otherwise mentioned in the product details page. Please refer the section of the product information page for the Period of Return i.e. period within which a product delivered can be returned by the Buyer subject to the other terms and conditions of the Return Policy contained hereunder.


 


Cancellation of Return Request


 


A request for return once made can be cancelled by contacting Customer Service. In case the Logistics Service provider arrives to receive the shipment and You want to cancel the request, you may choose to inform the logistics service provider that You do not wish to return the product. You will receive an email or SMS notification at the email address or mobile number provided to Pulimart cancelling Your return request.


 


Refusal of Return Request


 


Pulimart reserves the right to refuse or cancel any return request.  If the request for returns is not allowed by the Returns Policy, you will not be refunded the payment made or any costs and will not be able to raise a second request for return for the same product. You agree not to dispute the decision made by Pulimart and accept Pulimart’s decision regarding the refusal or cancellation and further agree not hold Pulimart liable for any refusal or cancellation.


 


Frivolous Complaints


 


In the event of frivolous or baseless complaints or requests regarding the quality or content of the products, Pulimart reserves the right to take necessary legal actions against You and You will be solely liable for all costs incurred by Pulimart in this regard.


 


Return Shipping Process


 


Self-send Process


 


In case of return of products initiated and subsequent courier of the product by You, if it is found that the returned product was not delivered to the seller or any other designated location specified or the package was empty, the onus shall be on You to prove through submission of proof of delivery from the concerned courier service provider to establish Your claim of return. Self-courier of returns should be initiated within the periods specified in the Pulimart’s Returns Policy. Pulimart is not liable to process the return request until satisfactory proof of delivery is provided to Pulimart.


 


In case of damage claims, Pulimart may ask for pictures of the damaged product before it is approved or allowed for return.


 


For return shipping managed by Pulimart, you will need to hand over the product to the assigned logistics service provider at the time of pick-up. In the event the logistics service provider makes attempts to pick-up the product and You are unavailable or not ready to handover the product, Pulimart or logistics service provider will not be held responsible for the delay in pick-up or processing of the quality check by the seller and hence the refund. A maximum of 2 attempts will be made by the logistics service provider to pick-up the product to be returned. Pulimart will not be liable for the products returned by mistake.


 


In the event where a product not belonging to the seller selling on Pulimart is returned by mistake, Pulimart is not accountable for such misplacement and is not responsible for its delivery back to You or any costs incurred by You or any refund.


 


Discrepancy Between Information Provided by You and Our Logistics Service Provider


 


In case of any discrepancy in the status of pick-up of a product arranged by Pulimart, (where You claim the product has been returned, while our system suggests otherwise) refund will be initiated only if You successfully furnish the courier slip given by the Pulimart assigned logistics service provider at the time of the pick-up.


 


In case where a seller or designated return location claims that the product received from You is different or the return of the product is not in compliance with the Returns Policy, the product will be dispatched back to Your shipping address and You are required to receive and accept the package. In the event of dispute, Pulimart will coordinate with You and the seller to reach an amicable solution.


 


 


 


REFUND POLICY


 


Refunds


 


Refunds are provided for cancellation / return of products, subject to the eligible cancellation/ return as per Return Policy or these terms and conditions, initiated in accordance with the Return or Cancellation Policy.


 


Refund is made for the full amount of the order or part order successfully cancelled that was paid by You for the delivery of the order.


 


For return requests, the refund of payment is made after the returned product has been received by the seller and has passed the quality checks. The entire product cost along with any taxes and shipping charges if any will be refunded to You.


 


If any refund is received by You pending the quality checks, you will hold such amounts in trust on behalf of Pulimart until conclusion of such quality checks unless claimed by Pulimart any time before that. If You are in receipt of any wrongful refunded or payment, you will transfer such amount back to Pulimart within 3 days of You receiving such amount.


 


No refund due to non-deliverability will be applicable to orders placed with Cash on Delivery options. Refund of Cash on Delivery orders returned by You may subject to levy of a charge which will be deducted from Your refund amount.


 


Time Period for Refunds


 


Refunds are normally processed within 1-15 working days after the completion of quality checks of product returned and further depends on various banking and payment channels.


Interest charged by the bank providing the EMI Scheme till the time the request for return or cancellation is raised will not be refunded. 


 


Pulimart is not responsible for any errors or delays in refund due to banks or third-party service provider errors or delays.


 


Mode of Refund


 


The mode of refund of payments cannot be changed at any stage as the refund amount is transferred to Your source account. Refunds are paid back to the source of payment.


 


Refund for payments made by modes other than Cash on Delivery, which fail when processed back to source may be refunded to Your bank account.


 


Refund of orders placed using Cash on Delivery as the payment method will be made by cheque or demand draft or to Your bank account via NEFT depending on the discretion of Pulimart.


 


You will need to update the bank account number and IFSC code to enable us to process a refund to Your account. Refunds cannot be processed to third-party accounts, i.e. the name on Your Pulimart account should match with the name of the bank account holder provided for refund via NEFT. A refund initiation confirmation by email or SMS at the email address or mobile number provided to Pulimart will be sent to You. A refund detail may be updated in ‘My order page’ under the respective order.


 


All refunds by cheque will be in form of "at par" cheques or via online transfer; basis sole discretion of Pulimart.


 


Terminated Payment Mode


 


If the original payment method You used to make the payment (credit or debit card or net banking) is no longer valid, we will issue the refund through a cheque. When we receive a payment failure notice from Your bank, we will send You an email asking You to call us. When You call us, we will collect Your address where You want the cheque to be sent, and proceed with the refund. Please refer to our Payment Policy for further details.


 


You explicitly give Your consent to receiving communications (by SMS, email or other mode of communication) sent to You by Pulimart, however, you may withdraw Your consent any time at Your sole discretion.


 

Returns & Cancellation

All products which are not delivered to You or returned by You in accordance with the Return Policy will be returned to the seller of the products except the case pulimart is the seller.


Return and cancellation of the products may be initiated in accordance with the Platform policies. Please review the Returns Policy and Cancellation Policy as applicable to the products purchased by You. The Platform may change the Returns Policy and Cancellation Policy without any notice.

Payment

Payment


Payment is an integral part of an online shopping experience. All payments shall be collected through secured payment options.


We accept all prepaid payment options such as all the major Credit Cards, Debit Cards, Net-Banking etc. Pulimart may also offers industry-leading solution for Cash on Delivery.


While availing any of the payment method/s offered by us, we are not responsible or take no liability of whatsoever nature in respect of any loss or damage arising directly or indirectly to you out of the decline due to:




  1. lack of authorization for any transaction/s, 
    2. or exceeding the preset limit mutually agreed by you and between your "Bank/s", 
    3. or any payment issues arising out of the transaction,
    4. or decline of transaction for any other reason/s. 


All payments made against the purchases/services on Pulimart by you shall be compulsorily in Indian Rupees acceptable by the Union of India. Pulimart does not accept any other form of currency with respect to the purchases.
Before shipping your order to you, we may request you to provide supporting documents (including but not limited to Govt. issued ID and address proof) to establish the ownership of the payment instrument used by you for your purchase. This is done in the interest of providing a safe online shopping environment to our users.


 


Issues with Payments - Pending Payments:


 


Payments can sometimes fail or remain in the pending stage. Some of the reasons could be:


 



  1.  Incorrect debit or credit card details are entered.

  2. Card may be blocked or card details are no longer valid or need to be updated.


3    The page is accidentally closed or refreshed or backspace is pressed while the transaction is being processed by Your bank.



  1. The connection between Pulimart and Your bank or issuer failed due to some technical reasons and the transaction could not be completed.

  2. Card or bank or issuer is not recognised by Pulimart.

  3. Incorrect login or password details are entered.

  4. Payment amount exceeds the limit mutually agreed to between You and Your bank or issuer.


If You face any of the above payment issues, try placing the order again in a short while or contact Your bank or issuer for technical assistance. Pulimart is not liable for any loss or inconvenience caused to You when making payment or for any wrongful debits to Your cards or net banking accounts.


 


 


 


Issuing Bank Terms and Conditions


 


Users understand and acknowledge that all payments made by the Users using valid credit card/ Debit card/ Cash Card/ and other payment instruments or mechanism including net banking facility will be processed using a payment gateway or appropriate payment system infrastructure and the same is governed by a separate set of terms and conditions agreed between the User and the respective Issuing Bank and payment instrument issuing company.


 


Requirements of Permanent Account Number (PAN)


 


For all the purchase of an amount equal to or exceeding INR 2,00,000 (INR two lakhs only), You will be required to upload a copy of Your PAN card, within such time as may be prescribed from the date of purchase, failing which, the purchase made by You will be automatically cancelled. The order shall also stand cancelled if there is a discrepancy between Your name in Account with Pulimart the name printed on the PAN card.


 


The requirement to provide a copy of PAN card is one-time activity and You don’t need to submit it again.
